 The Kashmir Conflict arises from the Partition of India in 1947 into modern India and Pakistan. Both the countries have made claims to Kashmir, based on historical developments and religious affiliations of the Kashmiri people.

Indian PM said:

“Kashmir should decide question of accession by plebiscite or referendum under international auspices such as those of the United Nations.” JAWAHARLAL NEHRU, (Letter No. 368-Primin dated 21 November 1947 to Prime Minister of Pakistan).

UN Security Council Resolution 47, called for a plebiscite to be held for Kashmir’s citizens. It also called for observers in Kashmir and an enlargement of the UNCIP’s membership. Since 1947 there are 26 UN resolutions on Kashmir, waiting for implementation.

The state of Jammu and Kashmir, which lies strategically in the north-west of the subcontinent, bordering China and the former Soviet Union, was a princely state ruled by Maharaja Hari Singh under the paramountcy of British India. In geographical and legal terms, the Maharaja could have joined either of the two new Dominions. Although urged by the Viceroy, Lord Mountbatten of Burma, to determine the future of his state before the transfer of power took place, Singh demurred. In October 1947, incursions and counter-incursions by Pakistan and India took place leading to a war, as a result of which the state of Jammu and Kashmir remains divided between the two countries.

Two-thirds of the former princely state (known as the Indian state of Jammu and Kashmir), comprising Jammu, the Kashmir Valley, and the sparsely populated Buddhist area of Ladakh are controlled by India; one-third is administered by Pakistan. The latter includes a narrow strip of land called Azad Kashmir and the Northern Areas, compromising the Gilgit AgencyBaltistan, and the former kingdoms of Hunza and Nagar. Attempts to resolve the dispute through political discussions were unsuccessful. In September 1965, war broke out again between Pakistan and India. The United Nations called for another cease-fire, and peace was restored once again following the Tashkent Declaration in 1966, by which both nations returned to their original positions along the demarcated line. After the 1971 war and the creation of independent Bangladesh, under the terms of the 1972 Simla Agreement between Prime Minister Indira Gandhi of India and Zulfiqar Ali Bhutto of Pakistan, it was agreed that neither country would seek to alter the cease-fire line in Kashmir, which was renamed as the Line of Control, “unilaterally, irrespective of mutual differences and legal interpretations”.

Numerous violations of the Line of Control have occurred, including the incursions by insurgents and Pakistani armed forces at Kargil leading to the Kargil war. There are also sporadic clashes on theSiachen Glacier, where the Line of Control is not demarcated and both countries maintain forces at altitudes rising to 20,000 ft (6,100 m).

Pakistan’s claims to the disputed region are based on the rejection of Indian claims to Kashmir, namely the Instrument of Accession. Pakistan insists that the Maharaja was not a popular leader, and was regarded as a tyrant by most Kashmiris. Pakistan maintains that the Maharaja used brute force to suppress the population. Pakistan accuses India of hypocrisy, as it refused to recognize the accession of Junagadh to Pakistan and Hyderabad‘s independence, on the grounds that those two states had Hindu majorities (in fact, India had occupied and forcibly integrated those two territories). Since he had fled Kashmir due to Pakistani invasion, Pakistan asserts that the Maharaja held no authority in determining Kashmir’s future. Pakistan argues that even if the Maharaja had any authority in determining the plight of Kashmir, he signed the Instrument of Accession under duress, thus invalidating the legitimacy of his actions.

Pakistan claims that Indian forces were in Kashmir before the Instrument of Accession was signed with India, and that therefore Indian troops were in Kashmir in violation of the Standstill Agreement, which was designed to maintain the status quo in Kashmir (although India was not signatory to the Agreement, which was signed between Pakistan and the Hindu ruler of Jammu and Kashmir).

From 1990 to 1999, some organizations reported that the Indian Armed Forces, its paramilitary groups, and counter-insurgent militias were responsible for the deaths 4,501 Kashmiri civilians. Also from 1990 to 1999, there were records of 4,242 women between the ages of 7–70 being raped.Similar allegations were also made by some human rights organizations.

In short, Pakistan holds that:

  • The popular Kashmiri insurgency demonstrates that the Kashmiri people no longer wish to remain within India. Pakistan suggests that this means that Kashmir either wants to be with Pakistan or independent.
  • According to the two-nation theory, which is one of the theories that is cited for the partition that created India and Pakistan, Kashmir should have been with Pakistan, because it has a Muslim majority.
  • India has shown disregard to the resolutions of the UN Security Council and the United Nations Commission in India and Pakistan by failing to hold a plebiscite to determine the future allegiance of the state.
  • The Kashmiri people have now been forced by circumstances to uphold their right of self-determination through militancy. Pakistan claims to give the Kashmiri insurgents moral, ethical and military support (1999 Kargil Conflict).
  • Recent protests in Indian-administered Kashmir attracted a large number of people to massive rallies that took place to oppose Indian control of the state.
  • Pakistan points to the violence that accompanies elections in Indian Kashmir and the anti Indian sentiments expressed by some people in the state.
  • Pakistan has noted the widespread use of extrajudicial killings in Indian-administered Kashmir carried out by Indian security forces while claiming they were caught up in encounters with militants. These encounters are commonplace in Indian-administered Kashmir. The encounters go largely uninvestigated by the authorities, and the perpetrators are spared criminal prosecution.
  • Pakistan points towards reports from the United Nations which condemn India for its human rights violations against Kashmiri people. Human rights organizations have strongly condemned Indian troops for widespread rape and murder of innocent civilians while accusing these civilians of being militants.
  • Pakistan President Asif Ali Zardari stated in October 2008 that Kashmiri ‘freedom fighters’ were terrorists. His remarks were met with widespread condemnation across Pakistan and Kashmir, including from prominent politicians.
  • The Chenab formula was a compromise proposed in the 1960s, in which the Kashmir valley and other Muslim-dominated areas north of the Chenab river would go to Pakistan, and Jammu and other Hindu-dominated regions would go to India.

Indian Oppression, Human Rights violations in Kashmir

According to a recent report on Human Rights violations in Indian Occupied Kashmir by Indian Army and its paramilitary forces, there have been deaths of 93,274 innocent Kashmiri from 1989 to June 30, 2010. Besides this alarming figure of open killings by its security forces, there have been 6,969 custodial killings, 117,345 arrests, destruction, and razing of 105,861 houses and other physical structures in the use of the community as a whole. The brutal security forces have orphaned over 107, 351 children, widowed 22,728 women and gang raped 9,920 women. In June 2010 only, there have been 33 deaths including four children besides, torturing and injuring 572 people. The brutal Indian security forces molested eight women during this one month. This brief account indeed, is the reality of Indian achievements on which they are trumpeting for their success in the Kashmir through counter insurgency operations. [Oppression updates [….]

کشمیر – انسانی حقوق کا مسئلہ

مقبوضہ کشمیر کے حریت پسند گروپوں میں کچھ گروپ کشمیر کے مکمل خودمختار آزادی کے حامی ہیں تو کچھ اسے پاکستان کا حصہ بنانا چاہتے ہیں۔ہندوستان پورے جموں اور کشمیر پر ملکیت کا دعوے دار ہے۔ 2010 میں ہندوستان کا کنٹرول 43 فیصد حصے پر تھا جس میں مقبوضہ کشمیر، جموں، لداخ اور سیاچن گلیشئر شامل ہیں جبکہ پاکستان کے پاس 37 فیصد حصہ آزاد کشمیر اور گلگت بلتستان کی شکل میں ہے۔

پاکستان اور بھارت دونوں مسئلہ کشمیر پر ایک بنیادی نظریے پر کھڑے ہونے کا دعوٰی کرتے ہیں۔ تقسیم ہند کے دوران جموں و کشمیر برطانوی راج کے زیر تسلط ایک ریاست ہوتا تھا۔جس کی آبادی 95 فیصد آبادی مسلم تھی۔ جب ہندوستان کو تقسیم کیا جارہا تھا تو جن علاقوں میں مسلم اکثریت تھی وہ علاقے پاکستان اور جہاں ہندو اکثریت تھی وہ علاقے بھارت کو دیئے گئے۔ پر کشمیر میں اکثریتی آبادی تو مسلمان تھے لیکن یہاں کا حکمران ایک سکھ تھا اور سیکھ حکمران چاہتا تھا کہ بھارت کے ساتھ ہوجائے ۔ لیکن تحریک پاکستان کے رہنماؤں نے اس بات کو مسترد کیا۔ آج بھی پاکستان کا ماننا ہے کہ کشمیر میں مسلمان زیادہ ہیں اسلئے یہ پاکستان کا حصہ ہے اور بھارت کا ماننا ہے کہ اس پر سکھ حکمران تھا جو بھارت سے الحاق کرنا چاہتا تھا اسلئے یہ بھارت کا حصہ ہے۔

١٩٤٨ کی جنگ کشمیر میں بھارت اقوام متحدہ میں چلا گیا اور اقوام متحدہ کی قرار دادوں کے مطابق کشمیریوں کو حق خود ارادیت سے اپنے مستقبل کا فیصلہ کرنے کا وعدہ کیا جس پر ابھی تک بھارت کی ہت دھرمی کی وجہ سے عمل درآمد نہ ہو سکا –

کشمیر دنیا کا وہ بدقسمت خطہ ہے جس کو انسانوں سمیت 75 لاکھ نانک شاہی میں خرید کر غلام بنایا گیا تو کبھی جابرانہ فیصلے کے ذریعے اقلیت نے اکثریت پر حکمرانی کی، انصاف کے عالمی دعویداروں نے ہمیشہ انصاف کے نام پر کشمیریوں کی نسل کشی اور تباہی کے منصوبوں کا ساتھ دیا۔ کشمیریوں نے آزادی کے لیے کئی لاکھ جانبازوں کی قربانی دی مگر عالمی قوتوں کی منافقت کے باعث آزادی کی یہ جنگ ظلم جبر اور تشدد کا نہ صرف سبب بنی بلکہ جنت نظیر وادی ایک فوجی کیمپٟ خوف، مایوسی اور تاریکی کی تصویر بنی ہوئی ہے۔ کشمیر وہ خطہ ہے جس کی ماضی میں مثال خوبصورتی، سرسبز و شادابی، قدرتی حسن، بلند و بالا پہاڑ، دنیا کے بہترین پھلوں، میووں، برف پوش پہاڑی سلسلوں، حسین وادیوں، یہاں کے باسیوں کے مثالی اخلاق اور جفاکشی، اسلام دوستی، محبت و بھائی چارہ، دنیا کے مختلف خطوں میں کشمیری نوجوانوں کی مثالی خدمات اور اعلیٰ صلاحیتوں کے حوالے سے دی جاتی تھی اور کشمیر کا ذکر آتے ہی انہی چیزوں کا تصور ذہن میں آتا تھا مگر آج جب کوئی شخص کشمیر کا ذکر کرتا ہے تو فوراً جلاؤ گھیراؤ، فوجی کیمپ، عورتوں کی عصمت دری، خوف، ظلم و ستم، تشدد، غلامی، مایوسی، قتل و غارت، بچوں کا تاریک مستقبل، تقسیم در تقسیم لائن آف کنٹرول (ایل او سی) اور بھارتی تسلط کا تصور ذہن میں آتا ہے۔ تاہم اس سب کچھ کے باوجود کشمیریوں نے امید کا دامن نہیں چھوڑا ہے۔ بے انتہا جانی و مالی نقصانات کے باوجود کشمیر کے عظیم سپوتوں نے اپنی آزادی کا سودا نہیں کیا۔

تنازع کشمیر کو دنیا کا قدیم ترین تنازع کہا جاتا ہے اور یہ بھی کہا جاتا ہے کہ اگر نام نہاد مہذب دنیا نے اس تنازع کو حل نہیں کیا تو شاید دنیا میں پہلی باقاعدہ عالمی ایٹمی جنگ اور پھر دنیا کی ایک بڑی تباہی کا سبب کشمیر ہی بنے گا۔ کشمیریوں کی جرات و بہادری اور بھارتی تسلط سے آزادی کے حصول کی جدوجہد سے اظہار یکجہتی کے طور پر پاکستانی قوم گزشتہ کئی دہائیوں سے ہر سال 5 فروری کو یوم یکجہتی کشمیر مناتی ہے۔

یاست جموں و کشمیر بنیادی طور پر 7 بڑے ریجنوں وادی کشمیر، جموں، کرگل، لداخ، بلتستان، گلگت اور پونچھ اور درجنوں چھوٹے ریجنوں پر مشتمل 84 ہزار 471 مربع میل پر پھیلی ہوئی ہے۔ یہ ریاست آبادی کے حساب سے اقوام متحدہ کے 140 اور رقبے کے حساب سے 112 رکن ممالک سے بڑی ہے۔ مذکورہ بالا تمام ریجنوں کی اپنی اپنی ایک تاریخ ہے جو ہزاروں سال پر محیط ہے۔ ماہرین ارضیات کا کہنا ہے کہ دس کروڑ سال قبل یہ خطہ سمندر میں ڈوبا ہوا تھا مگر آہستہ آہستہ خطے کی سر زمین وجود میں آئی اور اس عمل کو بھی 10 کروڑ سال گزر چکے ہیں۔ ہزاروں سالہ تاریخ کا جب مطالعہ کیا جاتا ہے تو کبھی کشمیر کی ریاست دہلی سے کابل، کبھی لداخ سے سندھ کے ساحل کراچی تک پھیلی نظر آتی ہے اور کبھی اسی ریاست میں درجنوں چھوٹی بڑی آزاد ریاستیں نظر آتی ہیں۔ آج کی دنیا میں جس ریاست کی بات کی جاتی ہے وہ 15 اگست 1947ء کو قائم ہوئی۔ ریاست جموں و کشمیر ہے اور اقوام متحدہ میں یہی پوری ریاست متنازعہ کشمیر قرار پائی۔ کشمیریوں کی بدقسمتی کا آغاز 16 مارچ 1846 کو میں معاہدہ امرتسر کے ساتھ ہی ہوا جس کے ذریعے گلاب سنگھ نے انگریز سے 75 لاکھ نانک شاہی میں جموں و کشمیر اور ہزارہ کا علاقہ خرید کر غلام بنایا جبکہ گلگت بلتستان، کرگل اور لداخ کے علاقوں پر قبضہ کر کے ایک مضبوط اور مستحکم ریاست قائم کی، مہاراجہ کشمیر نے مسلمانوں پر ظلم و ستم کی انتہا کردی کیونکہ حکمراں طبقہ اقلیتی تھا جبکہ خطے کی 85 فیصد آبادی مسلمانوں کی تھی اس لئے حکمراں ہمیشہ مسلمانوں سے ہی خطرہ محسوس کرتے تھے۔ مہاراجہ نے مسلمانوں کو پسماندہ رکھنے کے لئے بڑی کوششیں کیں یہی وجہ ہے کہ 1846 کے بعد ڈوگرہ حکمرانوں کے خلاف 1931 تک کوئی نمایاں آواز نہیں اٹھی اگرچہ اس عرصے میں مسلمانوں کی نصف درجن سے زائد انجمنیں یا جماعتیں بن چکی تھیں مگر ڈوگرہ کے ظلم و ستم کی وجہ سے مسلمان سر نہ اٹھا سکے۔
ہم جب ریاست جموں و کشمیر کا جائزہ لیتے ہیں تو ڈوگرہ حکمرانوں کے دور میں 1924 تک سیاسی خاموشی نظر آتی ہے۔ یہ خاموشی 1924 میں اس وقت ٹوٹی جب سرینگر میں کام کرنے والے ریشم کے کارخانوں کے مزدوروں نے اپنے اوپر ہونے والے مظالم کے خلاف آواز اٹھائی اور پوری ریاست نے ان کی آواز میں آواز ملائی اور یوں پوری ریاست سراپا احتجاج بن گئی، اس تحریک کو بھی ڈوگروں نے طاقت کے زور پر ختم کرنے کی کوشش کی، وقتی طور پر یہ تحریک کمزور ضرور ہوئی مگر اس کے بعد ریاست کے عوام میں بیداری آئی اور آزادی کا جذبہ توانا ہوا۔۔ ڈوگرہ حاکم کی کوشش رہی کہ ریاست کو بھارت کا حصہ بنایا جائے یا اس کی خود مختار حیثیت کو بحال رکھا جائے جبکہ مسلمانوں کا مطالبہ ریاست کو پاکستان کا حصہ بنانا تھا مگر ڈوگرہ تاخیری حربے استعمال کرتا رہا یہی وجہ ہے کہ 24 اکتوبر 1947 کو آزاد کشمیر میں آزاد حکومت کے قیام کے ساتھ ہی مجاہدین نے سرینگر کی طرف رخ کیا اور سرینگر تک کے علاقے پر قبضہ کرلیا اور مہاراجہ کشمیر دارالحکومت سے بھاگ کر جموں چلا گیا۔
26 اکتوبر 1947 کو مہاراجہ کشمیر نے نہ صرف بھارت سے فوجی امداد طلب کی بلکہ بھارت کے ساتھ الحاق کی درخواست بھی دی اور بھارت چونکہ کشمیر پر قبضے لیے موقع کی تلاش میں تھا لہٰذا 27 اکتوبر 1947 کو بھارتی افواج کشمیر پر قابض ہوگئیں، دوسری طرف پاکستان کی غلط حکمت عملی کی وجہ سے مجاہدین کو آزاد کیا ہوا ایک بڑا علاقہ بھی خالی کرنا پڑا اور مجبوراً پسپائی اختیار کرنا پڑی، بھارت کشمیر میں اس وعدے کے ساتھ داخل ہوا تھا کہ امن کے قیام کے بعد کشمیر سے واپس چلا جائیگا مگر آج تک بھارت کی واپسی نہیں ہوئی۔
دوسری طرف جب سرینگر میں بھارتی قبضہ ہوا اور آزاد کشمیر میں آزاد حکومت قائم ہوئی تو یکم نومبر 1947 کو گلگت میں بھی بغاوت ہوئی۔ ڈوگرہ گورنر گھنسارا سنگھ کو گرفتار کر کے اسلامی جمہوریہ گلگت کی بنیاد رکھی گئی جبکہ بلتستان اور وادی گریز(تراگبل، قمری، کلشئی، منی مرگ) اور دیگر علاقوں میں 1948 تک جنگ جاری رہی۔ 16 نومبر 1947 کو پاکستان نے اس پر کنٹرول کیا انگریز کے برصغیر سے جانے کے بعد کشمیریوں کو ڈوگرہ سے آزادی تو ملی مگر ریاست جموں و کشمیر کا ایک بڑا حصہ بھارتی غلامی میں چلا گیا۔ جب سے اب تک تنازع کشمیر پوری دنیا بالخصوص جنوبی ایشیا کے لئے ایک سنگین مسئلہ بنتا جا رہا ہے۔
مسئلہ کشمیر انتہا کو پہنچ چکا ہے۔ پاکستان کشمیریوں کی جدوجہد کو اپنا مسئلہ سمجھیں اور غیرت ایمانی کا مظاہرہ کرتے ہوئے کشمیر کو بھارت کے قبضے سے نجات دلا کر دم لے۔

آپ جانتے ہیں کہ پاکستان کشمیر کے بغیر ہر حوالے سے نامکمل ہے۔ اب پاکستان کو نامکمل رکھنے کے لئے ہمارے دشمن پاکستان کو تحریک آزادی کشمیر سے الگ کرنے کی گہری چال چل رہے ہیں۔ یہ تاثر دیا جا رہا ہے کہ پاکستان کشمیر کے محاذ پر ناکام ہوا ہے۔ اس پروپیگنڈے کا مقصد پاکستان میں کشمیر کے حوالے سے بے بسی کے احساس کو جنم دے کر جوش عمل ٹھنڈا کرنا ہے۔ ورنہ حقائق اس کے برعکس ہیں۔ 
کشمیر کے محاذ پر تحریک پاکستان کے دور سے لے کر آج تک کی تاریخ پاکستان کی زبردست کامیابی اور برہمن عزائم کی مسلسل شکست سے عبارت ہے۔ کانگریس نے ہر ممکن کوشش کی کہ قیام پاکستان سے پہلے ہی پوری ریاست جموں و کشمیر بھارت کا حصہ بن جائے۔ انگریزوں نے ہر مرحلے پر ان کا بھرپور ساتھ دیا۔ اس مقصد کے لئے پہلے ماؤنٹ بیٹن اور پھر گاندھی نے تقسیم ہند سے ذرا پہلے کشمیر کا دورہ کیا بعدمیں جب بھارت نے فوجی جارحیت کے ذریعے کشمیر کو ہڑپ کرنا چاہا تو ہم نے کم و بیش نصف ریاست یعنی آزاد کشمیر اور گلگت بلتستان کو زور بازو سے آزاد کر لیا۔ 
یہ بات قابل ذکر ہے کہ مقبوضہ وادی کشمیر کی علامتی و سیاسی اہمیت گو کہ زیادہ ہے مگر اقتصادی امکانات کے لحاظ سے آزاد کشمیر اور گلگت بلتستان کی اہمیت اور افادیت اس سے بھی زیادہ ہے۔ وادی کشمیر پر پاکستان کا اپنا برحق دعویٰ برقرار رکھنا اور وہاں پر بھارت کے خلاف مزاحمت کا مسلسل کسی نہ کسی صورت جاری رہنا ہماری کامیابی اور بھارت کی ناکامی اور پسپائی کی دلیل ہے۔ یہی وجہ ہے کہ کشمیر آج تک بین الاقوامی قانون کی رو سے متنازع علاقوں میں شمار ہوتا ہے اور جب تک پاکستان کشمیر پر اپنے دعوے پر ڈٹا رہے گا کشمیر ہرگز بھی بھارت کا قانونی حصہ نہیں بن سکے گا۔ 
مجرمانہ قومی غفلتوں سے ہم نے پاکستان کا جو حشر کیا ہے اس کی وجہ سے ہم اب تک مقبوضہ کشمیر کو آزاد نہیں کروا سکے اور نہ اس وقت تک کروا سکتے ہیں جب تک پاکستان اقتصادی اور عسکری میدانوں میں بھرپور خود کفالت کی منزل کو نہیں پالیتا۔ خود کفیل، باعزم اور توانا پاکستان ہی بھارت اور اس کے مغربی حواریوں سے آنکھوں میں آنکھیں ڈال کر بات کرنے اور کشمیر کو حاصل کرنے کے لئے فیصلہ کن اقدام کرنے کے قابل ہوگا۔ 
یہ پروپیگنڈہ بھی کیا جا رہا ہے کہ وادی کشمیر کے مسلمان پاکستان سے کشمیر کا الحاق نہیں چاہتے اس جھوٹی مہم کا مقصد پاکستان کی رائے عامہ کو فریب دینا ہے۔ کشمیر کے زمینی حقائق پر طائرانہ نظر ہی اس پروپیگنڈے کو جھٹلانے کے لئے کافی ہے۔ کشمیر قیام پاکستان سے پہلے ہی نظریہ پاکستان پر ایمان کا مضبوط قلعہ بن چکا تھا۔ وہاں کی مسلمان اکثریت کی پاکستان سے پختہ نظریاتی اور جذباتی وابستگی میں کبھی بھی ضعف نہیں آیا۔ امریکی دباؤ میں آکر طول اقتدار کے لئے فوجی آمر جنرل مشرف نے کامیابیوں کی طرف گامزن 90ء کی دہائی کی آزادی کشمیر کے لئے جاری خونین مزاحمت کی حمایت سے دست برداری کا اعلان کیا۔ اس مجرمانہ فعل سے مسلح مزاحمت کا گلا گھونٹا گیا۔ ان حالات میں پاکستان دشمن اور بھارت نواز الحادی عناصر کے لئے مسلمانان کشمیر کو پاکستان سے بدظن کرنے کے لئے موزوں ماحول میسر رہا۔ وادی کشمیر کی بابصیرت مسلم رائے عامہ نے ان حوصلہ شکن حالات میں بھی ہر موقع پر پاکستان سے اپنی لازوال وابستگی کا بھرپور اظہار کیا۔ 2008ء میں ہندو مذہبی استھانوں کو زمین کی منتقلی کے خلاف احتجاج سے شروع ہونے والی پرامن تحریک آزادی کے دوران لاکھوں مظاہرین کے اجتماعات میں لہرائے جانے والے سبز ہلالی پرچم اور بلند ہونے والے نعرے عوام کے دلی رجحانات کی ترجمانی کرنے کے لئے کافی تھے۔ پاکستان سے رشتہ کیا لاالہ الا اللہ، تیری منڈی، میری منڈی، راولپنڈی، راولپنڈی اور یہ تو بہانہ ہے راولپنڈی جانا ہے جیسے نعروں سے وادی کی فضائیں گونج رہی تھیں۔ 
2010ء میں پرامن عوامی مزاحمت کی آگ ایک بار پھر بھڑک اٹھی۔ چار ماہ تک لوگ اس تحریک کو بھرپور انداز سے چلاتے رہے۔ قابض انتظامیہ کے پاس کرفیو لگانے کے علاوہ کوئی راستہ نہ بچا تھا۔ عید رمضان کے دن قابض انتظامیہ نے یہ سوچ کر کرفیو اٹھایا کہ لوگ عید کی نماز کے بعد گھروں کا رخ کریں گے۔ آزادی کے جذبوں سے لبریز کشمیر کے مسلمان سری نگر کے مرکز لال چوک کی طرف گامزن ہوئے اور لاکھوں کے اجتماع میں سبز ہلالی پرچم اور پاکستان سے وابستگی کی خواہش کی ترجمانی کرنے والے فلک شگاف نعروں سے مقبوضہ فضاؤں پر لرزہ طاری ہوگیا۔ عید کی چھٹی کے بعد جب پاکستان میں اخبارات چھپے تو ایک انگریز اخبار میں لال چوک کے اس اجتماع کی تصویر بھی چھپی تھی جس میں گھنٹہ گھر پر آویزاں بڑے پاکستانی پرچم کے ساتھ ساتھ لوگوں کے ہاتھوں میں لہراتے ہوئے پاکستانی پرچموں کی بہار تھی۔ یہ تصویر اپنی بغل میں چھپی اس شہ سرخی کو جھٹلا رہی تھی کہ (دس میں سے ایک بھی کشمیری پاکستان سے الحاق نہیں چاہتا ہے) ناقابل یقین اور حیرت ناک جھوٹ ٹائمز آف انڈیا اخبار کے ذریعے مقبوضہ کشمیر میں کرائے گئے نام نہاد سروے میں بیان ہوئی تھی۔ اس دوران یہ خبر بھی اخبارات کی زینت بنی کہ بھارتی خاتون صحافی ارونا دھتی رائے جب سرینگر میں اہل دانش وبینش کے ایک بڑے اجتماع سے خطاب کر رہی تھیں تو سامعین نے نعرے بلند کئے: ”بھوکا ننگا ہندوستان، جان سے پیارا پاکستان“۔ 
دراصل تحریک آزادی کشمیر کے خلاف خطرناک سازش ہو رہی ہے اس سازش کا مقصد تحریک کو اس بنیاد سے محروم کرنا ہے جس پر یہ کھڑی ہے۔ مزاحمتی تحریکوں کی مضبوطی سخت جانی اور پائیداری ان کی نظریاتی بنیادوں میں پنہاں ہوتی ہے۔ جس مزاحمت کی نظریاتی بنیاد گہری، مضبوط اور شکست نا پذیر ہو اسے وقتی طور پر تو دبایا جاسکتا ہے مگر ختم نہیں کیا جاسکتا۔ آزادی کشمیر کے لئے جاری مزاحمت کی نظریاتی بنیاد جغرافیہ، سیاست، تاریخ اور دین و مذہب کے اٹل حقائق پر استوار ہے۔ اس نظریاتی بنیاد سے جدوجہد آزادی کو محروم کرنا اسے موت کے گھاٹ اتارنے کے برابر ہے۔ دراصل اس نظریاتی بنیاد میں تحریک آزادی کی روح بسی ہے۔ تحریک آزادی کی اس روح کا نام پاکستانیت ہے اور جب تک یہ تحریک حسب روایت پاکستانیت سے عبارت ہے اسے ختم کرنا یا اس کا استحصال کرنا خارج از امکان ہے۔ 
دنیا میں ریاست یا ملک انسانی اجتماعیت کی سب سے منظم، فعال اور طاقتور صورت کا نام ہے۔ پاکستانیت کی بنیاد پر کھڑی آزادیٴ کشمیر کی جدوجہد کا والی اور وارث بیس کروڑ افراد پر مشتمل پاکستان ہے۔ پاکستانیت سے تحریک آزادیٴ کشمیر کو وہ تزویراتی گہرائی میسر ہے جس کا خاتمہ دشمن کے بس کی بات نہیں۔ یہی وجہ ہے کہ اس تحریک سے جان چھڑانے اور اس کی جڑوں پر تیشہ چلانے کے لئے چالاکی سے اس تحریک کا پاکستانیت سے رشتہ توڑنے کے منصوبے پر کام ہور ہا ہے۔ 
تاریخی طور پر اس نامسعود سلسلے کا آغاز امریکہ نے کیا تھا۔ یاد رہے کہ امریکہ عالمی سیاست میں دوسری عالمی جنگ کے بعد اس برطانیہ کا جانشین بن کر سامنے آیا جس نے کشمیر پر بھارتی قبضے کے راستے ہموار کئے تھے۔ 18اکتوبر 1968ء کے دن صدر ایوب خان نے پاکستان میں متعین امریکی سفیر جو بھارت اور مقبوضہ کشمیر کادورہ کرکے آیا تھا سے ملاقات کا احوال اپنے روزنامچہ/ ڈائری میں درج کیا ہے۔ اس ملاقات میں امریکی سفیر ایوب خان سے تاکید کے ساتھ کہتا ہے کہ پاکستان کو انڈی پینڈیٹ کشمیر کے لئے کام کرنا چاہئے اور دلیل یہ دی ہے کہ اس طرح اسے عالمی طاقتوں کی حمایت حاصل ہو جائے گی۔ انڈی پینڈنٹ کشمیر کو عالمی حمایت کے حاصل ہونے والی بات پر ذراساغور وخوض ہی ہمیں اس کے برعکس نتیجے کے برآمد ہونے کا پتہ دیتا ہے۔ مسئلہ کشمیر کی بین الاقوامی حیثیت اور عالمی اہمیت صرف اور صرف پاکستان کا جموں و کشمیر کے دعویٰ دار ہونے کی وجہ سے رہی ہے۔ حیدر آباد دکن پر بھارت نے فوجی کارروائی کرکے قبضہ کیا۔ اس ریاست کے نمائندے نے اقوام متحدہ میں اس کے خلاف درخواست دائر کی تھی جس کی آج تک شنوائی نہیں ہوئی۔ کشمیر کے برعکس حیدر آباد دکن کا پاکستان ہمسایہ تھا نہ دعویدار اور مددگار۔ نہ رہا بانس نہ بجی بانسری۔ 
یاد رہے کہ انڈی پینڈنٹ کشمیر کا عملی قیام امریکہ بھارت گٹھ جوڑ کا ہرگز بھی مقصد نہیں۔ وہ جانتے ہیں کہ عملی دنیا میں اس کا کوئی امکان نہیں ہے۔ دراصل بھارت کشمیر سے اس طرح پاکستان کو الگ کرکے اسے آسانی سے ہضم کرنا چاہتا ہے۔ پاکستان کے لئے انڈی پینڈنٹ کشمیر کے تصور کا قابل قبول بن جانے کا منطقی نتیجہ تحریک آزادی کشمیر کے لئے پیغام موت ہوگا۔ انڈی پینڈنٹ کشمیر کے تصور کو قبول کرنے کا معنی یہ ہوگا کہ پاکستان وادی کشمیر کے بغیر ادھورا یا نامکمل نہیں ہے۔ وہ پاکستان جو خود کو وادی کشمیر کے بغیر مکمل تصور کرے گا اس کا ”قومی مفاد“ یہ کہنے لگے کا کہ اتنے چھوٹے سے کشمیر کے لئے اتنے بڑے بھارت سے پنگا لینے کی کیا ضرورت ہے اور یوں بھارت سے کشمیر کو آزاد کرنے کی تحریک تاریخ کے قبرستان میں دفنائی جائے گی۔ خدا نہ کرے ۔ خدارا آنکھیں کھولئے اور اس سازش کو سمجھئے۔
